Inheritance Law for UAE Expats

Protect Your Assets with Al Weaam Legal Services

Like other Middle Eastern countries, the UAE applies Sharia Law principles to many aspects of life, including inheritance. This can have significant implications for expats. Within Sharia, rules for distributing assets upon death are clearly outlined. Historically, these rules applied to both Muslims and non-Muslims in the UAE, often creating challenges for expats who preferred different arrangements.

In recent years, significant changes have been made to UAE inheritance laws, allowing expats more flexibility in managing their estate. However, taking the right legal steps is essential to secure your family’s future and ensure your assets are distributed according to your wishes.

The UAE introduced amendments to inheritance laws in November 2020 (Article 1 of Law No. 30 of 2020), giving expats greater control over the distribution of their estate. Expats can now register a will specifying whether their assets should follow the laws of their home country or their personal wishes.
Without a valid will, however, Sharia Law provisions apply, which could result in:

  • Frozen Accounts: Bank accounts, including joint accounts, are frozen until the courts decide how to distribute assets.

  • Unequal Asset Distribution: Under Sharia, male relatives may receive a larger share, leaving the surviving spouse or children with limited portions.
  • Guardianship Issues: In the absence of a will, guardianship of children may default to male family members under Sharia.

To avoid these complications, expats are strongly encouraged to create and register a will covering all financial assets, real estate, businesses, and guardianship preferences.
